Social Security Disability

Social Security Disability and the Federal Employee

Federal employees often find themselves dealing with three separate disability systems at the same time: OWCP under FECA, disability retirement through OPM, and Social Security Disability Insurance (SSDI) through the Social Security Administration. Each program asks different questions, uses different records, and reaches its own decisions. Understanding where those systems overlap can help explain award letters, benefit offsets, and payment changes.

Separating Benefits

SSDI as a Different Program

SSDI is a Social Security Administration benefit program. It is not administered by OWCP or OPM. The Social Security Administration reviews its own medical and vocational evidence and applies its own legal standard. A person may have an SSDI claim, a FECA claim, and a FERS disability retirement claim at the same time. Each file moves through a separate agency and decision process.

Comparing Medical Standards

SSDI generally requires a medical condition that has prevented, or is expected to prevent, substantial gainful activity for at least 12 consecutive months, or a disabling condition expected to result in death. OPM disability retirement asks whether a medical condition prevents useful and efficient service in the employee's federal position, or a qualifying reassigned position. FECA focuses on work-related injury or illness and the resulting disability. These standards overlap, but they are not identical. A favorable decision in one system does not control the others.

Different Standard

SSDI measures ability to perform substantial gainful activity in the national economy, not just your federal position.

Separate Decisions

An SSDI approval does not automatically win OWCP or OPM benefits. A denial does not automatically defeat them either.

Benefit Offsets

FECA payments may reduce SSDI, while SSDI may reduce a FERS disability annuity. Different offset rules apply.

File Coordination

Work attempts, job offers, and medical updates should be consistent across SSDI, FECA, and FERS records.

Required Steps

Why FERS Employees Are Told to File

Applying for SSDI is generally part of the FERS disability retirement process. OPM generally requires proof that the employee applied for SSDI, but SSDI approval is not required to qualify for FERS disability retirement. The programs use different disability standards. Employees should address the application requirement even if they expect Social Security to deny benefits.

How Feca and Social Security Interact

FECA wage-loss compensation and schedule awards can reduce the amount of SSDI payable. SSA applies this workers’ compensation offset to SSDI; OWCP does not reduce FECA compensation simply because SSDI is awarded. A different rule applies to Social Security retirement benefits: OWCP may reduce FECA wage-loss compensation by the portion attributable to federal service. SSDI automatically converts to retirement benefits at full retirement age, which can change how the programs interact. The benefit type, payment periods, and earnings records matter.

What an Award Does to FERS Disability

FERS disability retirement is designed to interact with SSDI. When SSDI benefits are awarded, the FERS disability annuity may be reduced under the applicable offset rules. OPM may calculate that reduction using the SSDI amount before SSA reduces it for a FECA schedule award. A retroactive SSDI award can also create an OPM overpayment for months already paid. Notify OPM promptly of an SSDI award and obtain advice before spending a retroactive payment.

What Aumiller Lomax Does and Does Not Handle

Our firm represents federal employees in FECA and federal disability retirement matters. We help clients understand how an SSDI application, denial, or award affects their related FECA and FERS benefits. We do not represent applicants in SSDI claims or appeals before the Social Security Administration.

When the Three Files Need to Be Read Together

Medical records, work attempts, trial work activity, OWCP job offers, and vocational evidence can appear in multiple systems at once. An explanation that makes sense in one file should not create problems in another.

Questions About Benefits Offsets

If you have received an SSA award letter or a notice changing your FECA or FERS payments, contact Aumiller Lomax for a free telephone consultation. We can discuss how the benefits interact, what may be causing the change, and whether representation would be helpful. Have relevant award letters, payment notices, and decisions available during the call, and tell us about any response deadline.
